Welcome! Come on in to learn what’s up and what’s down, legally speaking, when using Tikete.
For adding the event from the front end, you have to go to the Events tab. Now, click on the “Add New Event” button in order to get started.
After that, add generic information like the event’s title, description, relevant images, and social media links.
Note: Here the Event title* and Event description* field is the required field. Without filling in these fields, you can’t submit the event from the front end.
Once you are happy with the information, click the “Next” button at the bottom and you will be taken to another page. Now, add other information like venue, timezone, event start and end time, etc.
In the second step, you will see the ticket details options. You can set ticket variations, price, number of tickets, and min/max quantity. You can add multiple variations for your events by clicking on the “Add” button.
Submit the events and the event will add them to the event list. You can see a successful event-created pop-up on the page.
On this page, you can view every event that has been submitted. Moreover, you also have the options to preview, edit and update events.
You can check event-specific attendees from the events page. Just click on the “Attendee List” and you will be taken to the attendee list. From there, you can see the list of attendees and ticket status. You can also edit attendee details from the “Action” option as per your needs.
Here you can update attendee details by clicking on the toggle button. You can update your payment status, name, email, and check-in status.
You can scan and confirm attendees to your events by using the ‘Ticket Scanner’ option. Once you click on the button, the scanner will show up on the screen. You can also use any third-party scanner by connecting it to your device.
Tikete is a fully responsive and mobile-friendly. Its QR code scanner Scan. Just log in to your panel and scan the tickets.
Account registration is not necessary to browse the site. However, to access and utilize features such as registering an event and/or purchasing tickets, it will be necessary to establish an account. You are solely and entirely responsible for all activities conducted through your account, including but not limited to the purchase of tickets, protecting and safeguarding your user name and password, and ensuring that your account does not improperly or wrongfully infringe upon the rights of other persons, etc. We will not be liable for any and all harm related to the unauthorized use of your account or any and all harm arising from or related to your unauthorized or impermissible use of another’s account. You agree to notify us immediately and in writing within two (2) days of discovering and/or determining any unauthorized use of or security breach of your account. You agree that if any issues arise that may comprise the security of your account, as well as issues of your account infringing on the rights of others, that we may require you to change your user identification and password and that such a determination is at our sole discretion and your failure or refusal to comply may result in your account being surrendered and deactivated. We reserve the right to refuse registration, cancel an account, or deny access to the Site for any reason. YOU MUST BE 18 YEARS OF AGE OR OLDER TO USE THE TIKETE WEBSITE- CHILDREN UNDER THE AGE OF 18 ARE NOT AUTHORIZED TO USE THIS SITE TO REGISTER EVENTS AND/OR PURCHASE TICKETS.
You agree that your use of the Site will comply with and conform to all applicable laws, rules and regulations. You further agree that you will not use the Site in an unauthorized and unlawful manner of any kind, including but not limited to copyright infringement or infringement on any other third-party rights, submitting defamatory, fraudulent and/or objectionable content of any kind, misusing the Site for unauthorized and improper commercial purposes or solicitation of any kind or form, up to and including any and all improper and wrongful conduct recognized under law. When using this Site, you agree that you will not impersonate any person or entity, whether actual or fictious, including any person affiliated with TIKETE regardless of capacity.
The User also agrees to refrain from submitting any information, posts, links, etc. that may be deemed harassing and/or objectionable and that may victimize, degrade or intimidate an individual or group of individuals based on religion, race, ethnicity, sexual orientation, gender, age or disability. You agree not to engage in spamming, harvesting or collecting information about Site users and agree not to engage in any activity of any kind that may interfere with the proper use and functioning of the Site and/or its programming.
The conduct set forth above is to be interpreted as broadly and inclusively as possible and shall not be considered limited in any manner whatsoever, and any type of unauthorized, improper, unlawful or wrongful conduct on the part of the user shall be deemed a violation of the code of conduct that you agree to abide by when accessing and using the Site. Your agreement to comply with the Code of Conduct is effective upon accessing the Site. Furthermore, parents understand and agree that they are solely responsible for their minor child’s use of the Site, regardless of whether the parents authorized the minor child’s use of the Site.
You understand and agree that your use the Site is solely limited to the service(s) offered by the Site. You understand and agree that any use of the Content and Features of the Site that is not expressly authorized and/or provided as a service offered by the Site shall constitute wrongful, unauthorized and/or improper use of the Site whether designated as commercial or non-commercial, and that the user is entirely liable for the user’s conduct when using the Site.
The user is granted a limited, conditional no-cost, non-exclusive, non-transferable, non-sublicense license to view the Site and its Contents in accordance with and as permitted under the terms of use. The Site in intended to permit the use of any computer program, bot, robot, spider, offline reader, site search/retrieval application, or other manual or automatic device, tool, or process to retrieve, index, data mine, or in any way reproduce or circumvent the security structure, navigational structure, or presentation of the Content or the Site, including with respect to any CAPTCHA displayed on the Site. Operators of public search engines may use spiders to copy materials from the Site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. We may revoke this exception at any time and require removal of archived materials gathered in the past.
Agreed Upon Conditions Precedent to the Use of the Site

This license is expressly conditioned on your preexisting agreement to comply with, and your actual compliance with, each of the provisions described in this Ownership of Content and Grant of Conditional License section. Any use of the Site or Content by you or anyone acting on your behalf that does not strictly comply with each and every provision in this section exceeds the scope of the license granted to you herein, constitutes unauthorized reproduction, display, or creation of unauthorized derivative versions of the Site and Content, and infringes our copyrights, trademarks, patents, and other rights in the Site and Content. You will not acquire any ownership rights by using the Site or the Content.
You agree that when making any ticket purchase through the TIKETE Site, that the terms and conditions provision set forth herein will govern your purchase of any tickets bought through the Site, including any refunds or exchanges. You will pay all charges incurred by you or any users of your account and credit card (or other applicable payment mechanism) at the price(s) in effect when such charges are incurred, including any applicable taxes. You may only use credit or debit cards that belong to you or to people who expressly authorize you to use such payment methods.
You may not attempt to conceal your identity by using multiple Internet Protocol addresses or email addresses, or by any other means, to conduct transactions on the Site. You may use credit cards, debit cards, or other third-party electronic payments methods, such as Pay Pal to make purchases on this Site provided that the accounts used for payment belong to you or others who have expressly authorized to use such payment methods. You agree that if you make unauthorized payments from any account or service not belonging to you, that you will not hold TIKETE liable for any unauthorized transactions that you make and will bear sole and entire responsibility for the charges incurred. You further agree to indemnify and hold TIKETE harmless for any liability to any third party that may arise from your unauthorized use of any payment account that does not belong to you.
You agree and understand that any refund due to you for cancelled events shall be strictly limited to the price of the ticket and that the refund will not include any service or other fees and taxes that may be included in the purchase transaction.
You will not hold us liable if you do not comply with laws related to your transactions. We may provide law enforcement with information you provide to us related to your transactions to assist in any investigation or prosecution of you.
If we are unable to verify or authenticate any information or tickets you provide during any registration, ordering, purchase, ticket posting, sale, authentication, delivery, payment, or remittance process, or any other process, or if we are no longer able to verify or authorize your credit card or bank account information, your tickets may be cancelled, we may refuse to honor all pending and future ticket purchases made with those credit card or bank accounts and/or via any online accounts associated with those credit card or bank accounts. We may also prohibit you from using the Site.
Under the Digital Millennium Copyright Act of 1998 (the DMCA), if you believe in good faith that any content on the Site infringes your copyright, you may send us a notice requesting that the content be removed. The notice must include: (a) your (or your agent`s) physical or electronic signature; (b) identification of any copyrighted work on our Site that is claimed to have been infringed upon; (c) identification of the content that is claimed to be infringing or the subject of infringing activity, including information reasonably sufficient to allow us to locate and identify the content on the Site; (d) your name, address, telephone number, and email address; (e) a statement that you have a good faith belief that use of the content is not authorized by you or your agent or the law; and (f) a statement that the information in the notification is accurate and, under penalty of perjury, that you or your agent is authorized to act on behalf of the copyright owner. If you believe in good faith that a notice of copyright infringement has been wrongly filed against you, you may send us a counter-notice. Any Notice of Copyright Infringement and counter-notices shall be sent to info@TIKETE.cl.
TIKETE, in its sole discretion, shall terminate the access of any user who violates or infringes upon any copyright owned by TIKETE, any entity associated with TIKETE or other third-party. You agree that Passiline’s service and software may include security components that allow for the protection of digital materials, and that the use of these materials is subject to the terms and rules of use established by TIKETE and/or those who provide content to the Site. You agree not to attempt to circumvent, evade or avoid in any manner the TIKETE’s terms and rules of use. Any unauthorized reproduction, distribution, public communication or publication, in whole or in part of the TIKETE Site content or service is strictly prohibited.
You acknowledge, understand and agree that the TIKETE software and service contain proprietary, trade secret and confidential information that is protected under law. You acknowledge, understand and agree that all content made available on the TIKETE Site, whether made available by TIKETE or Event Organizer’s is protected under copyright, trademark, patent, and/or any and all proprietary rights. You agree that you will not modify, lease, loan, sell, distribute or create derivative works based on TIKETE’s Service, Content or Software in whole or in part and will additionally refrain from any attempt to do so. You agree that TIKETE has granted the user a personal and individual, non-transferable, non-exclusive and limited right to use the software on a single computer or device, and you agree that you will not copy, modify, create derivative works from the software, or reverse engineer or reverse assemble, or other make any attempt to to discover any of the source codes, sell, assign, sublease, or make warranties of any kind in connection with the limited use license or in any manner seek to gain unauthorized access to the service or permit third parties to undertake and/or engage in the foregoing conduct and/or activities.
The Site contains or may contain links to other websites that may not be owned or operated by us. The fact that we may link to those websites does not indicate any approval or endorsement of those websites. Should you choose to access a link outside of the TIKETE Site, you are solely responsible for your conduct under the outside sites terms and conditions and agree to indemnify and hold TIKETE harmless for occurrences or consequences associated with your access and/or use of the third-party site which we have no control over. You further agree, that any dispute or issue arising from your use of the third-party site shall be resolved exclusively with the third-party site and that TIKETE shall in no manner be held responsible or liable for any part of the dispute regardless of whether or not the third party site was directly accessed via the Site or through any link.
We may investigate any violation of the Terms, including any form of unauthorized and/or improper use of the Site. Any and all information gathered during our investigation, regardless of the source of the information may be provided to law enforcement. We may take any legal action that we believe is appropriate or necessary pursuant to and consistent with these terms and conditions. You agree that monetary damages may not provide us a sufficient remedy, and that we may pursue injunctive or other relief should you violate these terms and conditions. You understand and agree that if we determine that you have violated the terms and conditions or the law, or for any other appropriate reason, we may cancel your account, remove all your User Content, and prevent you from accessing the Site at any time without notice to you. You will still be bound by your obligations under these terms and conditions which will remain in full force and effect. You agree to indemnify and hold harmless TIKETE from any liable to you or any third party for termination of your access to the Site or to your account or any other related information which will not be made available to you. You understand and agree that should circumstances arise which necessitate termination of your account, that in our sole determination, we may decline to to honor pending and future purchases, orders or any other transactions of any kind made from all accounts that may be associated with you and may exercise any other remedy available to us.
WE PROVIDE THE SITE AND THE CONTENT TO YOU “AS IS” AND “AS AVAILABLE”. OUR AGGREGATE LIABILITY ARISING OUT OF THE TERMS OR THE USE OF THE SITE WILL NOT EXCEED A REFUND FOR PURCHASES WHICH WILL NOT INCLUDE ANY APPLICABLE SERVICE FEES, TAXES OR OTHER ASSOCIATED FEES OF ANY KIND RELATED TO YOUR USE OF THE SITE. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, TIKETE DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TIKETE DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE MATERIAL WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE TIKETE SERVICES OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TIKETE DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OFOR THE RESULT OF THE USE OF THE CONTENTS IN THE TIKETE SERVICES IN RELATION TO THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. YOU (AND NOT TIKETE) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, DSC ASSUMES NO LIABILITY, WHETHER IN CONTRACT OR TORT, FOR ANY DIRECT, INDIRECT. SPECIAL. CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING (WITHOUT LIMITATION) DAMAGES FOR LOSS OF ANTICIPATED PROFITS OR REVENUE OR OTHER ECONOMIC LOSS IN CONNECTION WITH OR ARISING FROM ANY ACT OR OMISSION BY TIKETE, ITS AGENTS, AFFILIATES, JOINT VENTURE PARTNERS, INDEPENDENT CONTRACTORS, OR UNAFFILIATED THIRD PARTIES AS A RESULT OF ANY ACT OR OMISSION IN FULFILLMENT OF OR IN BREACH OF THESE TERMS OR THE PRIVACY POLICY BELOW.
If anyone brings a claim against us related to your use of the Site, the Content, your User Content, or your violation of the terms and conditions, you agree to indemnify, defend, and hold us and our affiliated companies, Event Organizers, suppliers, advertisers, and sponsors, and each of our officers, directors, employees, and agents, harmless from and against any and all claims, damages, losses, and expenses of any kind (including reasonable legal fees and costs). We reserve the right to take exclusive control and defense of any claim, and you will cooperate fully with us in asserting any available defenses.
YOU AND WE EACH AGREE THAT, EXCEPT AS PROVIDED BELOW, ANY DISPUTE, CLAIM, OR CONTROVERSY RELATING IN ANY WAY TO THE TERMS, YOUR USE OF THE SITE, OR PRODUCTS OR SERVICES SOLD, DISTRIBUTED, ISSUED, OR SERVICED BY OR THROUGH US, REGARDLESS OF WHEN THAT DISPUTE, CLAIM, OR CONTROVERSY AROSE-WILL BE RESOLVED SOLELY BY BINDING, INDIVIDUAL ARBITRATION AS SET FORTH IN THE TERMS, RATHER THAN IN COURT. YOU AND WE AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL. YOU AND WE FURTHER AGREE THAT ANY CLAIMS BROUGHT AGAINST EACH OTHER WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING.
You agree that prior to initiating arbitration that you will provide written notice of your intend to pursue informal dispute resolution proceedings. Your notice must be provided to us by email addressed to disputes@tikete.com The email must provide: your full name, email address and mailing address associated with your account. If you are represented by counsel, the email advising of your intention to pursue arbitration must also include your counsel’s name, email address and telephone number, along with a full description of your claim and any relief you believe that you are entitled to. Should we intend to pursue informal dispute resolution, will we will email you at the email address associated with your account and provide a brief description of our claim(s) and the relief sought, and our counsel`s name and contact information.
Both you and we agree that prior to initiating arbitration proceedings, with sixty (60 days) from the date of notice of intent to pursue arbitration, you and we will participate in an informal dispute resolution conference in a good faith to amicably and informally resolve any potential or impending disputes, that the dispute resolution conference may be conducted via telephone or video conference and that counsel for either party may participate in the informal dispute resolution conference. You further agree that the informal dispute resolution conference shall be treated as a confidential settlement negotiation and that confidentiality shall extend to any offers, promises, statements and conduct related to the informal dispute resolution conference.
The informal dispute resolution conference shall occur within sixty (60) days of receipt of the written notice described above, unless an extension is mutually agreed upon in writing by you and us. If, after participating in that conference, you and we have been unable to resolve the dispute, the claimant may commence an arbitration in accordance with this arbitration agreement. After complying with the informal dispute resolution conference, if the dispute not be resolved therein, either party wishing to commence arbitration must provide to the other party a Demand for Arbitration. You agree that the informal dispute resolution conference and the Demand for Arbitration Notice shall operate as conditions precedent to commencing arbitration and that failure to comply with either condition shall operate as a waiver of claims and/or arbitration. You understand and agree that prior to initiating arbitration, you must participate in an informal dispute resolution conference and provide the written Demand for Arbitration and that failure to comply with these terms shall operate as a waiver of claims and/or arbitration. The party that commences arbitration in compliance with the terms set forth above shall be solely responsible for paying the arbitration filing fee.
You agree that the interpretation and enforcement of the arbitration agreement set forth in the terms and conditions shall be governed by the Federal Arbitration Act of the United States of America, (9 U.S.C. § 1 et seq.), (“FAA”). You agree that for any reason, should the arbitration provision of the terms and conditions be deemed unenforceable, that the laws of the State of Florida shall govern without recourse to any provision of law conflicts and that venue shall be proper in Miami-Dade County, Florida, United States of America.
You agree that if any part or provision of the terms and conditions is/are determined to be illegal, invalid, or unenforceable, that: (a) that part shall nevertheless be enforced to the extent permissible in order to give effect to the intent of the terms and conditions; and (b) that all other provisions of the terms and conditions shall remain valid and enforceable.
TIKETE provides a service to event organizers, such as artists, venues, teams, fan clubs, promoters, and leagues, whereby tickets are sold for an artistic, sporting, cultural or private event that is posted on our Site. TIKETE provides a non-exlusive platform to Events Organizers to register and publish events and manage ticket sales. When you purchase a ticket for an event, TIKETE will be handling the purchase transaction and collecting payment for the Event Organizer.
By registering an event through the Platform, the Organizer authorizes TIKETE to make and withhold the charges on its account associated with the sale of tickets for its event. The Event Organizer is solely and exclusively responsible for the production and organization of the Event and TIKETE assumes no responsibility or liability for the production, management, security or performance of the event advertised. The Event Organizer will define the quantities and values of the tickets available for sale, the rules of access to events and other general terms and conditions associated with attendance at the event. The Event Organizer is solely responsible for providing tax receipts for the services it undertakes to deliver and for the payment of all taxes associated with the production of the event. TIKETE will not be responsible for the payment of VAT or any other tax derived from the sale of tickets that must be paid by the Event Organizers.
Event Organizer agrees to be solely responsible for the veracity of the advertising of the event registered on the TIKETE platform. Event Organizer agrees that TIKETE is not a financial institution nor does it provide banking or exchange services. Event Organizer understands and agrees that any funds collected and/or credited to a TIKETE account do not earn interest. By registering an event through the Platform, the Event Organizer authorizes TIKETE to make and withhold the charges on its account associated with the sale of tickets for its event. After deducting any commissions or service charges agreed to by the Event Organizer, TIKETE will transfer to the Event Organizer monies received from the sale of tickets for the event or events validly registered on its Site. TIKETE will issue to the organizer the corresponding tax receipt for the commissions and/or charges for services charged.
The terms and conditions that govern the registration and publication of the events promoted on the TIKETE Site on behalf of the Event Organizer may be contained in a separate agreement between the Event Organizer and TIKETE. The Event Organizer understands, agrees and acknowledges that the Site and any of its applicable trademarks, logos, copyrights, patents, system design, interface and/or all other legally protected intellectual property belongs solely and exclusively to TIKETE.
Event Organizer must be of legal age (18 years of age or older) to post events on the TIKETE Site. By registering for an account or when registering an event on the TIKETE Site, Event Organizer is affirming under penalty of perjury that the Event Organizer is of legal age to contract and use TIKETE services and that the user suffers from no condition that would result in a determination of insufficient or diminished capacity. The Event Organizer understands and agrees that all users of the Site must be 18 years of age or older and use of the Site shall serve as certification by the user that the user is of legal age (18 years old). The Event Organizer agrees to indemnify and hold TIKETE harmless from any and all liability that may arise from Event Organizer’s false attestation or misrepresentation of the user’s age. TIKETE does not gather or collect personal identification information from minor or those under the age of 18. If you are not 18 years of age DO NOT provide or post any personal identification information or other information on the TIKETE Site.
TIKETE does not own and will not make any claim of ownership to the content that the Event Organizer submits or makes available for inclusion for the registration of events. By presenting content for use or inclusion on the TIKETE platform, the Event Organizer agrees to comply with all copyright, patent, trademark and intellectual property protections, as well as all other legally protected rights belonging to the rightful owners of such property when providing content to TIKETE for inclusion on the Site. Event Organizer agrees to indemnify and hold TIKETE harmless for any and all violations and/or liability that may arise from the unauthorized use and/or infringement of protected third party property and legal rights.
Event Organizer grants TIKETE, free of charge, a world-wide non-exclusive, if applicable, license to use, distribute, reproduce, modify, adapt, translate, publish and communicate to the public, all content, regardless of form or medium, submitted for use and inclusion in publicly accessible areas of the TIKETE Site subject to all limitations of use for the Site established by TIKETE. You agree not to display, publish or use TIKETE’s logo, trademark(s) or service marks identifying or associated with TIKETE without TIKETE’s express written conssent. TIKETE reserves the right to change or amend its terms and conditions for use or and access to any of the Site features at any time without notice and this condition shall apply to all users of the Site. You understand and agree that there shall be no third party beneficiaries to any agreement between TIKETE and the user of its services which is governed by the terms and conditions established by TIKETE.
You acknowledge, understand and agree to use the TIKETE Site or service at your sole risk. The TIKETE service is provided “as is” and “as available.” TIKETE makes no warranties, express or implied, related to the use of its service, that the service will meet your needs, or that the service will be uninterrupted, timely, secure or error-free, that the quality of any products, services, information or other materials purchased, provided or obtained through the service will conform to your expectations. You agree that any material downloaded or otherwise obtained through the use of the Site was downloaded or obtained at your own discretion and risk and that you are solely responsible for any damage to your computer or loss of data resulting from your decision to download and content in connection with your use of the Site.
You agree that by registering your event for ticket sales, you are solely responsible for the planning of the event, the determination of the date(s), time(s), and venue(s) of the event, cost of tickets, rules of conduct for attendance at the event, security, and providing any and all necessary information related to the event to the purchasers of tickets. You understand and agree that TIKETE has no involvement of any kind with the event itself or any decisions or determinations related to the event. You agree that the Event Organizer is solely liable for all claims regardless of kind, that arise or may arise as a result of the advertising, sale of tickets, attendance at the event or decision to cancel, postpone or reschedule the event and hereby agree to fully indemnify and hold TIKETE harmless from any and all claims that may arise in connection with your exclusive control of the event regardless of form.
You agree to immediately notify TIKETE of any decision to cancel, postpone or reschedule an event so that this important information will be available on the Passine Site and to enable TIKETE to refund, if necessary, the price of ticket sales. You agree that it is the sole responsibility of the Event Organizer to provide time notice of event cancellations, postponements and rescheduling to the ticket purchasers and you further agree to indemnify TIKETE from any liability arising from your failure to timely provide the above-described notice to ticket purchasers. You agree that should you cancel, postpone or reschedule an event, that the price of the ticket(s) will be automatically refunded to the purchaser(s) for cancelled event, and if requested by purchaser(s) for postponed and rescheduled events. You expressly authorize TIKETE to refund the monies collected from ticket sells if the event is canceled, postponed or rescheduled. You agree that TIKETE is entitled to retain all commissions, service fees and taxes collected for the event due to cancellation, postponement and rescheduling and expressly waive any and all claims related to commissions, service fees and taxes collected by TIKETE. You expressly authorize TIKETE to withhold all funds collected from for the sale of event tickets for up to six (6) months from the date the event was scheduled to take place to enable TIKETE to process refunds for canceled, postponed or rescheduled events. You agree that you, the Event Organizer are solely responsible the obligation to reimburse the price of tickets. You agree that TIKETE will only be responsible for processing refunds for a period not exceeding six (6) months from the date the event was scheduled to take place and that you are responsible for all refunds that requested after the expiration of six (6) month period described above. You agree to reimburse TIKETE for all charges and/or fees assessed to TIKETE by a third party as a result of the cancellation, postponement or rescheduling of an event. You also authorize to TIKETE to deduct fees and/or charges assessed to TIKETE due to the cancellation, postponement or rescheduling of an event from your account and that if funds are insufficient to cover your obligations you will promptly reimburse TIKETE for any fees, charges and refund of ticket sales.
You agree and understand that TIKETE will only process refunds for ticket sales arising from the cancellation, postponement or rescheduling of an event. All other refunds for ticket purchases that are authorized by the Event Organizer shall be directly refunded by the Event Organizer.
When registering for an Event Organizer account, it is the responsibility of the Event Organizer to provide accurate and complete bank account information for the account the Event Organizer has designated to receive the monies collected by TIKETE for ticket sales. Event Organizer shall indemnify and hold TIKETE harmless for any delayed receipt and/or transfer to Event Organizer of monies collected from ticket sales due to the Event Organizer failing to provide accurate or complete banking account information. The Event Organizer agrees that it is solely responsible for ensuring and verifying the all bank account information provided to TIKETE is correct. Should any dispute arise during the use of TIKETE’s services, the Event Organizer authorizes and agrees that TIKETE shall retain collected funds until the dispute is resolved and that TIKETE shall first make all deductions for commissions and any other service fees or taxes from the revenue collected prior to transferring the amount due for ticket sales to the Event Organizer. Event Organizer agrees that the service fee charged by TIKETE may change from time to time without notice and that the agreed upon service fee for the use of TIKETE’s service was disclosed and accepted by the Event Organizer prior to posting the event. Event Organizer agrees that it is fully aware of all service fees and taxes that TIKETE assesses for the use of its service and authorizes TIKETE to make the agreed upon deductions prior to the transfer of ticket sales proceeds, if any, to the Event Organizer. The Event Organizer also agrees that the posting of an event on the TIKETE platform shall be conclusive proof of the Event Organizer’s acceptance and agreement to the foregoing terms and all other terms and conditions set forth herein under the TIKETE Terms and Conditions of Use.
Further, the Event Organizer agrees that if the monies for sales due to the Event Organizer are delayed because of any dispute resolution between the Event Organizer and TIKETE, that the Event Organizer will not be entitled to collect any interest of any kind from TIKETE arising in connection with the delayed transfer of sales proceeds to the Event Organizer. The Event Organizer further agrees to waive any and all claims, whether in contract or tort, against TIKETE that may arise due to the delayed transfer for ticket sales proceeds to the Event Organizer.
TIKETE will transfer the funds collected for the price and amount of ticket sales to the Event Organizer within fifteen (15) days of the conclusion of the event, provided that the fifteenth (15th) day is within the regular business days of Monday through Friday. Daily business shall be deemed concluded by 5 P.M. EST. Should the fifteenth (15th) day fall on a weekend, Saturday or Sunday, or a legal holiday, then TIKETE will transfer the amount due to the Event Organizer on the next regular business day.
The service provided by TIKETE is completely free for the Event Organizer. TIKETE charges the purchaser a service fee currently established at fifteen percent (15%), which is subject to change at any time and without notice. There may be other additional fees charged to the purchaser for the use of the TIKETE service, in addition to any taxes collected by TIKETE. These charges and fees shall be based on the purchase price of the ticket and shall be deducted from the Event Organizer’s account. Any wire transfer or other funds transfer fee, if applicable, shall be assessed against the Event Organizer and deducted from the sales proceeds to be transferred. It is the responsibility of the Event Organizer to promptly notify TIKETE of any changes to its banking account information and all losses and delays that arise from the Event Organizer’s failure to notify TIKETE of bank account information changes shall be attributable to the Event Organizer.
TIKETE sells tickets on behalf of Event Organizers, which means we do not set the ticket prices or determine event and/or seating locations. Event Organizers determine the prices of tickets for their events and the quantity of tickets available for events. TIKETE makes no guaranty that tickets will remain available because the available number of ticket can sell out and are made available to purchasers on a first come first served basis. Should tickets become available for resale, TIKETE makes no guaranty that the price will remain the same as the initial price because the resale of tickets may be offered through a third party who determines the price of the ticket. Event organizers may make additional tickets available and will determine the price of the tickets.
If you purchase a resale ticket through our Site, you will be purchasing that ticket from either (a) a reseller who is not an Event Organizer, such as other fans, season ticket holders, or professional resellers, or (b) in limited circumstances, the Event Organizer. Tickets that are obtained from unauthorized sources, and not directly through our Site, may be lost, stolen, or counterfeit, and, if so, are void. THE PRICE THAT YOU PAY FOR RESALE TICKETS MAY BE SUBSTANTIALLY HIGHER THAN THE FACE VALUE PRINTED ON THE TICKETS. Should you decide to purchase a resale ticket at a higher amount, you agree that you have voluntarily chosen to pay that amount when purchasing resale tickets and that you are not entitled to claim a refund from TIKETE for the difference in ticket price and/or any service fees and taxes charged by TIKETE in connection with the purchase of tickets.
Your order is confirmed when you receive a confirmation page or email (“Order Confirmation”). You agree that it is your responsibility to notify TIKETE if you do not receive an order confirmation that your order has been placed and accepted after having provided your payment information. After providing payment information, if you do not receive an order confirmation due to an error message or any other type of service interruption notice, you understand and agree that it is your responsibility to contact and notify TIKETE that an order confirmation was not received to verify that your order has been placed and processed. TIKETE will not be responsible for any losses that may result because an order confirmation was not received or any other losses that may occur because an order was not accepted and/or confirmed. If you do not receive a confirmation, it is your responsibility to contact customer service at the number provided on the Site.
Tickets purchased on our Site are subject to a per ticket service fee and an order processing fee. Under state and local laws, we are required to collect taxes on sales. We may display the tax separately or include it in the total service fee amount. A shipping or delivery fee may also be charged for your purchase. Any shipping or delivery charges are calculated based on delivery location and shipping method. Please note that the delivery fee, as well as the order processing fee, may not reflect the actual cost to deliver or process your order, and in some cases, these fees may include a profit to TIKETE for services that it provides. These provisions apply to the purchase of all tickets regardless of whether the ticket is designated as resale or otherwise.
Your ability to purchase tickets on the Site may be subject to a limit on the number of tickets that can be purchased by you. These ticket limits may be determined by the event organizer, TIKETE or any other third party associated with the offering of tickets to an event. Any ticket purchase limitations will be posted on the Site during the purchasing process and verified for every transaction. Each TIKETE account must belong to an individual who can provide valid and verifiable identification information. TIKETE will not tolerate attempts to avoid and/or circumvent ticket limits through the use of multiple accounts. Should a purchaser exceed or attempt to exceed ticket limits, TIKETE reserves the right to exercise its sole discretion to cancel orders and terminate your use of the Site. If your order is canceled due to violating ticket limits, we will refund only the purchase price of the ticket which will not include any service fees and/or taxes charged to you for your purchase order. This provision shall apply to orders placed under the same name, email address, billing address, credit card number, third party electronic payment account, such as PayPal, or any other information provided that indicates that a ticket limit violation has occurred.
Due to circumstances outside of TIKETE’s control, events may canceled, postponed, rescheduled on a different date or at different time, or moved to a different venue. If the event is canceled, you do not need to take any action to receive a refund. we will issue a refund to the original method of payment used at time of purchase, provided that funds are received by TIKETE from the original payment source of remitted to TIKETE from the Event Organizer. In some cases, you may be given the option to choose a refund or a credit. If this option is available, we will notify you so that you may select whether to receive a credit or refund.
If the event is postponed, rescheduled, or moved: your ticket(s) will remain valid, and no further action is required. However, the Event Organizer may provide an option to choose a refund or a credit for the event. This determination is at the sole discretion of the event organizer and TIKETE shall not be responsible for any liability associated with the cancellation, postponement, rescheduling or moving of any event venue. Event organizers establish the policies for credits and refunds associated with the cancellation, rescheduling, postponement and change of venue for their events. Event organizer policies shall not include any refunds of any service fees or taxes paid to TIKETE for use of its Site and/or services as these costs and/or fees are non-refundable.
If your event is canceled, postponed, rescheduled, or moved, we will attempt to contact you to update you on the status of the event, and inform you of any refund, credit, or exchange procedures. For exact instructions on any canceled, postponed, rescheduled, or moved event, please check the event information online and in your account (which will include the most current information on the status of the event), or contact us.
We will not be liable for travel or any other expenses that you or anyone else incurs in connection with a canceled, postponed, rescheduled, or moved event. You understand and agree that TIKETE provides the service of advertising an event and selling tickets on behalf of Event Organizers, otherwise, TIKETE has no involvement in the planning, production, establishing dates, times and venues for events, or determination of ticket prices, rules of conduct for attendance at events, event security or any other matter related to the event itself and only advertises the event as described by the Event Organizer and that all event related information is provided by the Event Organizer, who is solely responsible for the event and all decisions and determinations regarding the event.
All sales are final and refunds are only allowed in limited circumstances, as explained section 21 for events that are Canceled, Postponed, Rescheduled and relocated to a different venue. Before purchasing tickets, carefully review the event description, rules, terms and conditions and all other information provided by the Event Organizer. Policies set forth by Event Organizers and generally prohibit us from issuing exchanges or refunds after a ticket has been purchased, lost, stolen, damaged, or destroyed. If a refund is issued, it will be processed according to the terms and conditions authorized and agreed to by the Event Organizer and set forth pursuant to our refund policy.
All information on accounts and orders must be valid and are subject to verification. All orders are subject to credit card approval. Orders that are place using an account that cannot be verified in accordance with accepted industry standards and practices will not be processed and no order confirmation will be issued. Furthermore, if your order is not processed or canceled due to unauthorized account usage, we may sell your ticket(s) to another customer without further notice.
Different combinations of delivery methods may be offered, depending on a number of factors-including (but not limited to) the venue or country where the event is to be held, the country in which you live, whether the event is in person or virtual, how much time is left before the event starts, whether it is a holiday season, and the nature of the demand for the event Delivery options are determined by the Event Provider and can vary from event to event. For security purposes, we can only ship tickets to the billing address on file with the method of payment that is used for your purchase.
You voluntarily assume all risks and danger incidental to the event for which the ticket is purchased. You agree to indemnify and hold TIKETE harmless for any damage, loss, personal injury or any other type of harm that arises from your attendance at an event registered on our Site. You agree that TIKETE has only provided the service of advertising an event and selling tickets thereto, and is in no manner associated with the event itself and bears no liability of any kind for any event, occurrence or harm, regardless of the extent, that arises from your attendance at an event. You agree that TIKETE is not a party to any dispute between you and the Event Organizer and further agree to waive any and all claims against TIKETE and to fully indemnify TIKETE from any liability of any kind related to any dispute between you and the Event Organizer. You agree that prior to purchasing tickets for any event, that you read and understood the description of the event, the rules of attendance at the event, and any and all other terms and conditions provided by the Event Organizer and agreed to those terms and conditions.

The conduct set forth above is to be interpreted as broadly and inclusively as possible and shall not be considered limited in any manner whatsoever, and any type of unauthorized, improper, unlawful or wrongful conduct on the part of the user shall be deemed a violation of the code of conduct that you agree to abide by when accessing and using the Site. You will pay all charges incurred by you or any users of your account and credit card (or other applicable payment mechanism) at the price(s) in effect when such charges are incurred, including any applicable taxes. You may only use credit or debit cards that belong to you or to people who expressly authorize you to use such payment methods.
You may not attempt to conceal your identity by using multiple Internet Protocol addresses or email addresses, or by any other means, to conduct transactions on the Site. You agree and understand that any refund due to you for cancelled events shall be strictly limited to the price of the ticket and that the refund will not include any service or other fees and taxes that may be included in the purchase transaction.
You will not hold us liable if you do not comply with laws related to your transactions. We may provide law enforcement with information you provide to us related to your transactions to assist in any investigation or prosecution of you.
If we are unable to verify or authenticate any information or tickets you provide during any registration, ordering, purchase, ticket posting, sale, authentication, delivery, payment, or remittance process, or any other process, or if we are no longer able to verify or authorize your credit card or bank account information, your tickets may be cancelled, we may refuse to honor all pending and future ticket purchases made with those credit card or bank accounts and/or via any online accounts associated with those credit card or bank accounts. We may also prohibit you from using the Site.

TIKETE, in its sole discretion, shall terminate the access of any user who violates or infringes upon any copyright owned by TIKETE, any entity associated with TIKETE or other third-party. You agree that Passiline’s service and software may include security components that allow for the protection of digital materials, and that the use of these materials is subject to the terms and rules of use established by TIKETE and/or those who provide content to the Site. You agree not to attempt to circumvent, evade or avoid in any manner the TIKETE’s terms and rules of use. Any unauthorized reproduction, distribution, public communication or publication, in whole or in part of the TIKETE Site content or service is strictly prohibited.
You acknowledge, understand and agree that the TIKETE software and service contain proprietary, trade secret and confidential information that is protected under law. You acknowledge, understand and agree that all content made available on the TIKETE Site, whether made available by TIKETE or Event Organizer’s is protected under copyright, trademark, patent, and/or any and all proprietary rights. You agree that you will not modify, lease, loan, sell, distribute or create derivative works based on TIKETE’s Service, Content or Software in whole or in part and will additionally refrain from any attempt to do so. You agree that TIKETE has granted the user a personal and individual, non-transferable, non-exclusive and limited right to use the software on a single computer or device, and you agree that you will not copy, modify, create derivative works from the software, or reverse engineer or reverse assemble, or other make any attempt to to discover any of the source codes, sell, assign, sublease, or make warranties of any kind in connection with the limited use license or in any manner seek to gain unauthorized access to the service or permit third parties to undertake and/or engage in the foregoing conduct and/or activities.
The Site contains or may contain links to other websites that may not be owned or operated by us. The fact that we may link to those websites does not indicate any approval or endorsement of those websites. Should you choose to access a link outside of the TIKETE Site, you are solely responsible for your conduct under the outside sites terms and conditions and agree to indemnify and hold TIKETE harmless for occurrences or consequences associated with your access and/or use of the third-party site which we have no control over. You further agree, that any dispute or issue arising from your use of the third-party site shall be resolved exclusively with the third-party site and that TIKETE shall in no manner be held responsible or liable for any part of the dispute regardless of whether or not the third party site was directly accessed via the Site or through any link.
We may investigate any violation of the Terms, including any form of unauthorized and/or improper use of the Site. Any and all information gathered during our investigation, regardless of the source of the information may be provided to law enforcement. We may take any legal action that we believe is appropriate or necessary pursuant to and consistent with these terms and conditions. You agree that monetary damages may not provide us a sufficient remedy, and that we may pursue injunctive or other relief should you violate these terms and conditions. You understand and agree that if we determine that you have violated the terms and conditions or the law, or for any other appropriate reason, we may cancel your account, remove all your User Content, and prevent you from accessing the Site at any time without notice to you. You will still be bound by your obligations under these terms and conditions which will remain in full force and effect. You agree to indemnify and hold harmless TIKETE from any liable to you or any third party for termination of your access to the Site or to your account or any other related information which will not be made available to you. You understand and agree that should circumstances arise which necessitate termination of your account, that in our sole determination, we may decline to to honor pending and future purchases, orders or any other transactions of any kind made from all accounts that may be associated with you and may exercise any other remedy available to us.
WE PROVIDE THE SITE AND THE CONTENT TO YOU “AS IS” AND “AS AVAILABLE”. YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE SITE IS TO STOP USING THE SITE. THE ALLOCATION OF RISK BETWEEN US IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN US. OUR AGGREGATE LIABILITY ARISING OUT OF THE TERMS OR THE USE OF THE SITE WILL NOT EXCEED A REFUND FOR PURCHASES WHICH WILL NOT INCLUDE ANY APPLICABLE SERVICE FEES, TAXES OR OTHER ASSOCIATED FEES OF ANY KIND RELATED TO YOUR USE OF THE SITE. IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE. OUR LIABILITY WILL BE LIMITED UNDER THIS PARAGRAPH TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. YOU AGREE THAT THE PROVISIONS OF THIS PARAGRAPH SHALL OPERATE AS A WAIVER FOR THE RECOVERY OF ALL DAMAGES, ATTORNEYS` FEES, OR COSTS WITH THE EXCEPTION OF ANY AVAILABLE RECOVERY EXPRESSLY REFERENCED OR STATED HEREIN WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, TIKETE DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TIKETE DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE MATERIAL WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE TIKETE SERVICES OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TIKETE DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OFOR THE RESULT OF THE USE OF THE CONTENTS IN THE TIKETE SERVICES IN RELATION TO THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. YOU (AND NOT TIKETE) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, DSC ASSUMES NO LIABILITY, WHETHER IN CONTRACT OR TORT, FOR ANY DIRECT, INDIRECT. SPECIAL. CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING (WITHOUT LIMITATION) DAMAGES FOR LOSS OF ANTICIPATED PROFITS OR REVENUE OR OTHER ECONOMIC LOSS IN CONNECTION WITH OR ARISING FROM ANY ACT OR OMISSION BY TIKETE, ITS AGENTS, AFFILIATES, JOINT VENTURE PARTNERS, INDEPENDENT CONTRACTORS, OR UNAFFILIATED THIRD PARTIES AS A RESULT OF ANY ACT OR OMISSION IN FULFILLMENT OF OR IN BREACH OF THESE TERMS OR THE PRIVACY POLICY BELOW.
If anyone brings a claim against us related to your use of the Site, the Content, your User Content, or your violation of the terms and conditions, you agree to indemnify, defend, and hold us and our affiliated companies, Event Organizers, suppliers, advertisers, and sponsors, and each of our officers, directors, employees, and agents, harmless from and against any and all claims, damages, losses, and expenses of any kind (including reasonable legal fees and costs). We reserve the right to take exclusive control and defense of any claim, and you will cooperate fully with us in asserting any available defenses.
YOU AND WE EACH AGREE THAT, EXCEPT AS PROVIDED BELOW, ANY DISPUTE, CLAIM, OR CONTROVERSY RELATING IN ANY WAY TO THE TERMS, YOUR USE OF THE SITE, OR PRODUCTS OR SERVICES SOLD, DISTRIBUTED, ISSUED, OR SERVICED BY OR THROUGH US, REGARDLESS OF WHEN THAT DISPUTE, CLAIM, OR CONTROVERSY AROSE-WILL BE RESOLVED SOLELY BY BINDING, INDIVIDUAL ARBITRATION AS SET FORTH IN THE TERMS, RATHER THAN IN COURT. YOU AND WE AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL. YOU AND WE FURTHER AGREE THAT ANY CLAIMS BROUGHT AGAINST EACH OTHER WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING.
You agree that prior to initiating arbitration that you will provide written notice of your intend to pursue informal dispute resolution proceedings. Your notice must be provided to us by email addressed to disputes@tikete.com The email must provide: your full name, email address and mailing address associated with your account. If you are represented by counsel, the email advising of your intention to pursue arbitration must also include your counsel’s name, email address and telephone number, along with a full description of your claim and any relief you believe that you are entitled to. Should we intend to pursue informal dispute resolution, will we will email you at the email address associated with your account and provide a brief description of our claim(s) and the relief sought, and our counsel`s name and contact information.
Both you and we agree that prior to initiating arbitration proceedings, with sixty (60 days) from the date of notice of intent to pursue arbitration, you and we will participate in an informal dispute resolution conference in a good faith to amicably and informally resolve any potential or impending disputes, that the dispute resolution conference may be conducted via telephone or video conference and that counsel for either party may participate in the informal dispute resolution conference. You further agree that the informal dispute resolution conference shall be treated as a confidential settlement negotiation and that confidentiality shall extend to any offers, promises, statements and conduct related to the informal dispute resolution conference.
The informal dispute resolution conference shall occur within sixty (60) days of receipt of the written notice described above, unless an extension is mutually agreed upon in writing by you and us. If, after participating in that conference, you and we have been unable to resolve the dispute, the claimant may commence an arbitration in accordance with this arbitration agreement. After complying with the informal dispute resolution conference, if the dispute not be resolved therein, either party wishing to commence arbitration must provide to the other party a Demand for Arbitration. You agree that the informal dispute resolution conference and the Demand for Arbitration Notice shall operate as conditions precedent to commencing arbitration and that failure to comply with either condition shall operate as a waiver of claims and/or arbitration. You understand and agree that prior to initiating arbitration, you must participate in an informal dispute resolution conference and provide the written Demand for Arbitration and that failure to comply with these terms shall operate as a waiver of claims and/or arbitration. The party that commences arbitration in compliance with the terms set forth above shall be solely responsible for paying the arbitration filing fee.
You agree that the interpretation and enforcement of the arbitration agreement set forth in the terms and conditions shall be governed by the Federal Arbitration Act of the United States of America, (9 U.S.C. § 1 et seq.), (“FAA”). You agree that for any reason, should the arbitration provision of the terms and conditions be deemed unenforceable, that the laws of the State of Florida shall govern without recourse to any provision of law conflicts and that venue shall be proper in Miami-Dade County, Florida, United States of America.
You agree that if any part or provision of the terms and conditions is/are determined to be illegal, invalid, or unenforceable, that: (a) that part shall nevertheless be enforced to the extent permissible in order to give effect to the intent of the terms and conditions; and (b) that all other provisions of the terms and conditions shall remain valid and enforceable.
TIKETE provides a service to event organizers, such as artists, venues, teams, fan clubs, promoters, and leagues, whereby tickets are sold for an artistic, sporting, cultural or private event that is posted on our Site. TIKETE provides a non-exlusive platform to Events Organizers to register and publish events and manage ticket sales. When you purchase a ticket for an event, TIKETE will be handling the purchase transaction and collecting payment for the Event Organizer.
By registering an event through the Platform, the Organizer authorizes TIKETE to make and withhold the charges on its account associated with the sale of tickets for its event. The Event Organizer is solely and exclusively responsible for the production and organization of the Event and TIKETE assumes no responsibility or liability for the production, management, security or performance of the event advertised. The Event Organizer will define the quantities and values of the tickets available for sale, the rules of access to events and other general terms and conditions associated with attendance at the event. The Event Organizer is solely responsible for providing tax receipts for the services it undertakes to deliver and for the payment of all taxes associated with the production of the event. TIKETE will not be responsible for the payment of VAT or any other tax derived from the sale of tickets that must be paid by the Event Organizers.
Event Organizer agrees to be solely responsible for the veracity of the advertising of the event registered on the TIKETE platform. Event Organizer agrees that TIKETE is not a financial institution nor does it provide banking or exchange services. Event Organizer understands and agrees that any funds collected and/or credited to a TIKETE account do not earn interest. By registering an event through the Platform, the Event Organizer authorizes TIKETE to make and withhold the charges on its account associated with the sale of tickets for its event. After deducting any commissions or service charges agreed to by the Event Organizer, TIKETE will transfer to the Event Organizer monies received from the sale of tickets for the event or events validly registered on its Site. TIKETE will issue to the organizer the corresponding tax receipt for the commissions and/or charges for services charged.
The terms and conditions that govern the registration and publication of the events promoted on the TIKETE Site on behalf of the Event Organizer may be contained in a separate agreement between the Event Organizer and TIKETE. The Event Organizer understands, agrees and acknowledges that the Site and any of its applicable trademarks, logos, copyrights, patents, system design, interface and/or all other legally protected intellectual property belongs solely and exclusively to TIKETE.
Event Organizer must be of legal age (18 years of age or older) to post events on the TIKETE Site. By registering for an account or when registering an event on the TIKETE Site, Event Organizer is affirming under penalty of perjury that the Event Organizer is of legal age to contract and use TIKETE services and that the user suffers from no condition that would result in a determination of insufficient or diminished capacity. The Event Organizer understands and agrees that all users of the Site must be 18 years of age or older and use of the Site shall serve as certification by the user that the user is of legal age (18 years old). The Event Organizer agrees to indemnify and hold TIKETE harmless from any and all liability that may arise from Event Organizer’s false attestation or misrepresentation of the user’s age. TIKETE does not gather or collect personal identification information from minor or those under the age of 18. If you are not 18 years of age DO NOT provide or post any personal identification information or other information on the TIKETE Site.
TIKETE does not own and will not make any claim of ownership to the content that the Event Organizer submits or makes available for inclusion for the registration of events. By presenting content for use or inclusion on the TIKETE platform, the Event Organizer agrees to comply with all copyright, patent, trademark and intellectual property protections, as well as all other legally protected rights belonging to the rightful owners of such property when providing content to TIKETE for inclusion on the Site. Event Organizer agrees to indemnify and hold TIKETE harmless for any and all violations and/or liability that may arise from the unauthorized use and/or infringement of protected third party property and legal rights.
Event Organizer grants TIKETE, free of charge, a world-wide non-exclusive, if applicable, license to use, distribute, reproduce, modify, adapt, translate, publish and communicate to the public, all content, regardless of form or medium, submitted for use and inclusion in publicly accessible areas of the TIKETE Site subject to all limitations of use for the Site established by TIKETE. You agree not to display, publish or use TIKETE’s logo, trademark(s) or service marks identifying or associated with TIKETE without TIKETE’s express written conssent. TIKETE reserves the right to change or amend its terms and conditions for use or and access to any of the Site features at any time without notice and this condition shall apply to all users of the Site. You understand and agree that there shall be no third party beneficiaries to any agreement between TIKETE and the user of its services which is governed by the terms and conditions established by TIKETE.
You acknowledge, understand and agree to use the TIKETE Site or service at your sole risk. The TIKETE service is provided “as is” and “as available.” TIKETE makes no warranties, express or implied, related to the use of its service, that the service will meet your needs, or that the service will be uninterrupted, timely, secure or error-free, that the quality of any products, services, information or other materials purchased, provided or obtained through the service will conform to your expectations. You agree that any material downloaded or otherwise obtained through the use of the Site was downloaded or obtained at your own discretion and risk and that you are solely responsible for any damage to your computer or loss of data resulting from your decision to download and content in connection with your use of the Site.
You agree that by registering your event for ticket sales, you are solely responsible for the planning of the event, the determination of the date(s), time(s), and venue(s) of the event, cost of tickets, rules of conduct for attendance at the event, security, and providing any and all necessary information related to the event to the purchasers of tickets. You understand and agree that TIKETE has no involvement of any kind with the event itself or any decisions or determinations related to the event. You agree that the Event Organizer is solely liable for all claims regardless of kind, that arise or may arise as a result of the advertising, sale of tickets, attendance at the event or decision to cancel, postpone or reschedule the event and hereby agree to fully indemnify and hold TIKETE harmless from any and all claims that may arise in connection with your exclusive control of the event regardless of form.
You agree to immediately notify TIKETE of any decision to cancel, postpone or reschedule an event so that this important information will be available on the Passine Site and to enable TIKETE to refund, if necessary, the price of ticket sales. You agree that it is the sole responsibility of the Event Organizer to provide time notice of event cancellations, postponements and rescheduling to the ticket purchasers and you further agree to indemnify TIKETE from any liability arising from your failure to timely provide the above-described notice to ticket purchasers. You agree that should you cancel, postpone or reschedule an event, that the price of the ticket(s) will be automatically refunded to the purchaser(s) for cancelled event, and if requested by purchaser(s) for postponed and rescheduled events. You expressly authorize TIKETE to refund the monies collected from ticket sells if the event is canceled, postponed or rescheduled. You agree that TIKETE is entitled to retain all commissions, service fees and taxes collected for the event due to cancellation, postponement and rescheduling and expressly waive any and all claims related to commissions, service fees and taxes collected by TIKETE. You expressly authorize TIKETE to withhold all funds collected from for the sale of event tickets for up to six (6) months from the date the event was scheduled to take place to enable TIKETE to process refunds for canceled, postponed or rescheduled events. You agree that you, the Event Organizer are solely responsible the obligation to reimburse the price of tickets. You agree that TIKETE will only be responsible for processing refunds for a period not exceeding six (6) months from the date the event was scheduled to take place and that you are responsible for all refunds that requested after the expiration of six (6) month period described above. You agree to reimburse TIKETE for all charges and/or fees assessed to TIKETE by a third party as a result of the cancellation, postponement or rescheduling of an event. You also authorize to TIKETE to deduct fees and/or charges assessed to TIKETE due to the cancellation, postponement or rescheduling of an event from your account and that if funds are insufficient to cover your obligations you will promptly reimburse TIKETE for any fees, charges and refund of ticket sales.
You agree and understand that TIKETE will only process refunds for ticket sales arising from the cancellation, postponement or rescheduling of an event. All other refunds for ticket purchases that are authorized by the Event Organizer shall be directly refunded by the Event Organizer.
When registering for an Event Organizer account, it is the responsibility of the Event Organizer to provide accurate and complete bank account information for the account the Event Organizer has designated to receive the monies collected by TIKETE for ticket sales. Event Organizer shall indemnify and hold TIKETE harmless for any delayed receipt and/or transfer to Event Organizer of monies collected from ticket sales due to the Event Organizer failing to provide accurate or complete banking account information. The Event Organizer agrees that it is solely responsible for ensuring and verifying the all bank account information provided to TIKETE is correct. Should any dispute arise during the use of TIKETE’s services, the Event Organizer authorizes and agrees that TIKETE shall retain collected funds until the dispute is resolved and that TIKETE shall first make all deductions for commissions and any other service fees or taxes from the revenue collected prior to transferring the amount due for ticket sales to the Event Organizer. Event Organizer agrees that the service fee charged by TIKETE may change from time to time without notice and that the agreed upon service fee for the use of TIKETE’s service was disclosed and accepted by the Event Organizer prior to posting the event. Event Organizer agrees that it is fully aware of all service fees and taxes that TIKETE assesses for the use of its service and authorizes TIKETE to make the agreed upon deductions prior to the transfer of ticket sales proceeds, if any, to the Event Organizer. The Event Organizer also agrees that the posting of an event on the TIKETE platform shall be conclusive proof of the Event Organizer’s acceptance and agreement to the foregoing terms and all other terms and conditions set forth herein under the TIKETE Terms and Conditions of Use.
Further, the Event Organizer agrees that if the monies for sales due to the Event Organizer are delayed because of any dispute resolution between the Event Organizer and TIKETE, that the Event Organizer will not be entitled to collect any interest of any kind from TIKETE arising in connection with the delayed transfer of sales proceeds to the Event Organizer. The Event Organizer further agrees to waive any and all claims, whether in contract or tort, against TIKETE that may arise due to the delayed transfer for ticket sales proceeds to the Event Organizer.
TIKETE will transfer the funds collected for the price and amount of ticket sales to the Event Organizer within fifteen (15) days of the conclusion of the event, provided that the fifteenth (15th) day is within the regular business days of Monday through Friday. Daily business shall be deemed concluded by 5 P.M. EST. Should the fifteenth (15th) day fall on a weekend, Saturday or Sunday, or a legal holiday, then TIKETE will transfer the amount due to the Event Organizer on the next regular business day.
The service provided by TIKETE is completely free for the Event Organizer. TIKETE charges the purchaser a service fee currently established at fifteen percent (15%), which is subject to change at any time and without notice. There may be other additional fees charged to the purchaser for the use of the TIKETE service, in addition to any taxes collected by TIKETE. These charges and fees shall be based on the purchase price of the ticket and shall be deducted from the Event Organizer’s account. Any wire transfer or other funds transfer fee, if applicable, shall be assessed against the Event Organizer and deducted from the sales proceeds to be transferred. It is the responsibility of the Event Organizer to promptly notify TIKETE of any changes to its banking account information and all losses and delays that arise from the Event Organizer’s failure to notify TIKETE of bank account information changes shall be attributable to the Event Organizer.
TIKETE sells tickets on behalf of Event Organizers, which means we do not set the ticket prices or determine event and/or seating locations. Event Organizers determine the prices of tickets for their events and the quantity of tickets available for events. TIKETE makes no guaranty that tickets will remain available because the available number of ticket can sell out and are made available to purchasers on a first come first served basis. Should tickets become available for resale, TIKETE makes no guaranty that the price will remain the same as the initial price because the resale of tickets may be offered through a third party who determines the price of the ticket. Event organizers may make additional tickets available and will determine the price of the tickets.
If you purchase a resale ticket through our Site, you will be purchasing that ticket from either (a) a reseller who is not an Event Organizer, such as other fans, season ticket holders, or professional resellers, or (b) in limited circumstances, the Event Organizer. Tickets that are obtained from unauthorized sources, and not directly through our Site, may be lost, stolen, or counterfeit, and, if so, are void. THE PRICE THAT YOU PAY FOR RESALE TICKETS MAY BE SUBSTANTIALLY HIGHER THAN THE FACE VALUE PRINTED ON THE TICKETS. Should you decide to purchase a resale ticket at a higher amount, you agree that you have voluntarily chosen to pay that amount when purchasing resale tickets and that you are not entitled to claim a refund from TIKETE for the difference in ticket price and/or any service fees and taxes charged by TIKETE in connection with the purchase of tickets.
Your order is confirmed when you receive a confirmation page or email (“Order Confirmation”). You agree that it is your responsibility to notify TIKETE if you do not receive an order confirmation that your order has been placed and accepted after having provided your payment information. After providing payment information, if you do not receive an order confirmation due to an error message or any other type of service interruption notice, you understand and agree that it is your responsibility to contact and notify TIKETE that an order confirmation was not received to verify that your order has been placed and processed. TIKETE will not be responsible for any losses that may result because an order confirmation was not received or any other losses that may occur because an order was not accepted and/or confirmed. If you do not receive a confirmation, it is your responsibility to contact customer service at the number provided on the Site.
Tickets purchased on our Site are subject to a per ticket service fee and an order processing fee. Under state and local laws, we are required to collect taxes on sales. We may display the tax separately or include it in the total service fee amount. A shipping or delivery fee may also be charged for your purchase. Any shipping or delivery charges are calculated based on delivery location and shipping method. Please note that the delivery fee, as well as the order processing fee, may not reflect the actual cost to deliver or process your order, and in some cases, these fees may include a profit to TIKETE for services that it provides. These provisions apply to the purchase of all tickets regardless of whether the ticket is designated as resale or otherwise.
Your ability to purchase tickets on the Site may be subject to a limit on the number of tickets that can be purchased by you. These ticket limits may be determined by the event organizer, TIKETE or any other third party associated with the offering of tickets to an event. Any ticket purchase limitations will be posted on the Site during the purchasing process and verified for every transaction. Each TIKETE account must belong to an individual who can provide valid and verifiable identification information. TIKETE will not tolerate attempts to avoid and/or circumvent ticket limits through the use of multiple accounts. Should a purchaser exceed or attempt to exceed ticket limits, TIKETE reserves the right to exercise its sole discretion to cancel orders and terminate your use of the Site. If your order is canceled due to violating ticket limits, we will refund only the purchase price of the ticket which will not include any service fees and/or taxes charged to you for your purchase order. This provision shall apply to orders placed under the same name, email address, billing address, credit card number, third party electronic payment account, such as PayPal, or any other information provided that indicates that a ticket limit violation has occurred.
Due to circumstances outside of TIKETE’s control, events may canceled, postponed, rescheduled on a different date or at different time, or moved to a different venue. If the event is canceled, you do not need to take any action to receive a refund. we will issue a refund to the original method of payment used at time of purchase, provided that funds are received by TIKETE from the original payment source of remitted to TIKETE from the Event Organizer. In some cases, you may be given the option to choose a refund or a credit. If this option is available, we will notify you so that you may select whether to receive a credit or refund.
If the event is postponed, rescheduled, or moved: your ticket(s) will remain valid, and no further action is required. However, the Event Organizer may provide an option to choose a refund or a credit for the event. This determination is at the sole discretion of the event organizer and TIKETE shall not be responsible for any liability associated with the cancellation, postponement, rescheduling or moving of any event venue. Event organizers establish the policies for credits and refunds associated with the cancellation, rescheduling, postponement and change of venue for their events. Event organizer policies shall not include any refunds of any service fees or taxes paid to TIKETE for use of its Site and/or services as these costs and/or fees are non-refundable.
If your event is canceled, postponed, rescheduled, or moved, we will attempt to contact you to update you on the status of the event, and inform you of any refund, credit, or exchange procedures. For exact instructions on any canceled, postponed, rescheduled, or moved event, please check the event information online and in your account (which will include the most current information on the status of the event), or contact us.
We will not be liable for travel or any other expenses that you or anyone else incurs in connection with a canceled, postponed, rescheduled, or moved event. You understand and agree that TIKETE provides the service of advertising an event and selling tickets on behalf of Event Organizers, otherwise, TIKETE has no involvement in the planning, production, establishing dates, times and venues for events, or determination of ticket prices, rules of conduct for attendance at events, event security or any other matter related to the event itself and only advertises the event as described by the Event Organizer and that all event related information is provided by the Event Organizer, who is solely responsible for the event and all decisions and determinations regarding the event.
All sales are final and refunds are only allowed in limited circumstances, as explained section 21 for events that are Canceled, Postponed, Rescheduled and relocated to a different venue. Before purchasing tickets, carefully review the event description, rules, terms and conditions and all other information provided by the Event Organizer. Policies set forth by Event Organizers and generally prohibit us from issuing exchanges or refunds after a ticket has been purchased, lost, stolen, damaged, or destroyed. If a refund is issued, it will be processed according to the terms and conditions authorized and agreed to by the Event Organizer and set forth pursuant to our refund policy.
All information on accounts and orders must be valid and are subject to verification. All orders are subject to credit card approval. Orders that are place using an account that cannot be verified in accordance with accepted industry standards and practices will not be processed and no order confirmation will be issued. Furthermore, if your order is not processed or canceled due to unauthorized account usage, we may sell your ticket(s) to another customer without further notice.
Different combinations of delivery methods may be offered, depending on a number of factors-including (but not limited to) the venue or country where the event is to be held, the country in which you live, whether the event is in person or virtual, how much time is left before the event starts, whether it is a holiday season, and the nature of the demand for the event Delivery options are determined by the Event Provider and can vary from event to event. Please carefully review the list of delivery methods offered during the purchase process. For security purposes, we can only ship tickets to the billing address on file with the method of payment that is used for your purchase.
You voluntarily assume all risks and danger incidental to the event for which the ticket is purchased. You agree to indemnify and hold TIKETE harmless for any damage, loss, personal injury or any other type of harm that arises from your attendance at an event registered on our Site. You agree that TIKETE has only provided the service of advertising an event and selling tickets thereto, and is in no manner associated with the event itself and bears no liability of any kind for any event, occurrence or harm, regardless of the extent, that arises from your attendance at an event. You agree that TIKETE is not a party to any dispute between you and the Event Organizer and further agree to waive any and all claims against TIKETE and to fully indemnify TIKETE from any liability of any kind related to any dispute between you and the Event Organizer. You agree that prior to purchasing tickets for any event, that you read and understood the description of the event, the rules of attendance at the event, and any and all other terms and conditions provided by the Event Organizer and agreed to those terms and conditions.
Certain personal information must be provided to place an order or register an event. When signing up for an account, additional personal information may be required. This information may include your name, address, phone number, e-mail address, credit card number and expiration date, card verification number, etc. This information is used to process and complete your order and/or provide event registration services to you. In connection with your use of this Site, certain other information may also be collected. We may use cookie technology to track purchase selections prior to completing the purchase, to validate your identity, and to detect and prevent potentially fraudulent activity. We may also use web beacons to help analyze and audit web traffic.
